Sommer explains that well-drafted agreements can protect the company’s interests and bottom line, but unclear and overboard agreements are bound to result in expensive litigation. “Litigation over non-compete and confidentiality agreements is a lose-lose proposition for both parties. Even the winner doesn’t really win, but just loses less,” says Sommer, who is chairman of the employment and labor practice group at his firm.
